  1. Ken says:

Why wait for the Supreme Court? The mandate is hugely unpopular and Republicans should repeal it the minute they take control.

  2. Vicki says:

Kevin Drum has an incredibly cynical view of conservatives. But then look at where he’s coming from.

  3. Devon Herrick says:

It is hard to imagine the Supreme Court taking up a case so politically charged. If the mandate was created by legislative action, that how it needs to be dismantled.

  4. Larry C. says:

I agree with Megan. There is no political reason for the Supreme Court to uphold the mandate.

  5. Brian Williams. says:

James Madison may have miscalculated the modern reach of the Commerce Clause. While he acknowledged that “the regulations of commerce … is a new power,” Madison said that it “seems to be an addition which few oppose, and from which no apprehensions are entertained.”

Nevertheless, Madison firmly believed that the states would be able to protect against encroachments of power by the federal government. That’s largely the basis for these lawsuits. “The powers delegated by the Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite.”

Madison clearly didn’t understand the Constitution.

  6. Erik says:

The mandate will stand. Insurance companies and republicans secretly will ensure that. More upward redistribution of wealth. Pure Reaganomics.

  7. Davi says:

what kind of state government FORCES a law on buensiss and citizens when some are in financial crisis? no job market, forclosures, gas prices. I am totally outraged. this state will be forcing out it’s own citizens and buensisses.no one will want to live here with these outrageous laws.
