    I heard that the absence of a severability clause in the Affordable Care Act (ACA) was due to the fact that insurance regulations (guaranteed issue / community rating) has to be coupled with an individual mandate to prevent the insurance market from collapsing under the weight of people gaming the system in the individual mandate was struck down. But, then again, there are other theories that the lack of a severability clause was merely an oversight by the Democratic majority staff while trying to ram the ACA through Congress in as little a time as possible.

    Minor correction: Florida’s Senator, quoted in the article, is Bill Nelson. Ben Nelson is the Democratic Senator from Nebraska.
