The fact that 141 items in the tax code are temporary speaks volumes about why we are not coming out of the Great Recession. With all this uncertainty can you blame employers for hiring only temporary employees and avoiding major investments?
I’m not sure I would want to be fearless. Doesn’t fear provoke some self protective responses that are good for survival?
Mr. Antos writes that states are “required” to implement many elements of Obamacare. I’m not so sure. In fact, I’d swing the other way.
Many newly elected state legislators and governors ran against Obamacare, even asserting that it was unconstitutional. States have passed versions of the Freedom of Choice in Health Care Act as statutes or constitutional amendments.
Mr. Cuccinelli, the Virginia Attorney-General, has landed a successful blow against the law and the Florida A-G’s case is looking more favorable as a result.
Given that every one of these governors and legislators (and Attorneys-General and Insurance Commissioners) took an oath to uphold and defend the U.S. Constitution, they are on far more solid ground if they refuse to implement Obamacare. At least, they should be able to sleep better at night, knowing that they have not broken their oaths.
Antos is a wuss. We should repeal. And then reflect carefully on what to do next.
