It is not really accurate to say that ‘the judge rewrote the law.’
The judge interpreted the law by reviewing the actual Congressional debate.
That is not re-writing.
Although Michael Cannon is a fine writer, I always thought that this particular challenge was quite lame. It was almost Clintonesque in the way it found a few words (i.e. “on a state exchange”), and tried to lever these words into changing a major act of Congress.
Besides, it strained credulity to think that the plaintiffs in this suit could say that they were ‘harmed’ by getting a subsidy on the federal exchange. Harm me that way every day, I won’t complain.
